Welcome to APK Pure Games. These Terms of Service ("Terms") govern your access to and use of the APK Pure Games website, services, and applications (collectively, the "Services"). We make no claims or representations regarding, and accept no responsibility for, such third-party content. By using our Services, you acknowledge and agree that we are not responsible for examining or evaluating the content or accuracy of any third-party content, and we do not warrant and will not have any liability or responsibility for any third-party content.

Our Services allow you to download APK files for various applications and games. You acknowledge and agree that:

• You are solely responsible for your decision to download and install any APK file from our Services;
• The use of any application or game downloaded from our Services is at your own risk;
• We do not guarantee the functionality, security, or compatibility of any application or game available for download through our Services;
• You are responsible for ensuring that your use of any downloaded application or game complies with all applicable laws and terms of service.

Applications and games available through our Services may be subject to third-party licenses or terms of service. You agree to comply with all applicable third-party licenses or terms of service when using such applications or games.

WE DO NOT WARRANT THAT:

• OUR SERVICES WILL MEET YOUR REQUIREMENTS;
• OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
• THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF OUR SERVICES WILL BE ACCURATE OR RELIABLE;
• THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH OUR SERVICES WILL MEET YOUR EXPECTATIONS;
• ANY ERRORS IN OUR SERVICES WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF OUR SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

IN NO EVENT SHALL APK PURE GAMES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE OUR SERVICES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OUR SERVICES;
• ANY CONTENT OBTAINED FROM OUR SERVICES;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
• STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON OUR SERVICES;
• ANY OTHER MATTER RELATING TO OUR SERVICES.

THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF APK PURE GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless APK Pure Games, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to our Services;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
• Any claim that your User Content caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of our Services.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. If you are accessing our Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

Any dispute arising out of or relating to these Terms or our Services shall be resolved by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such arbitration shall be conducted in English and shall take place in California, United States. The arbitration shall be conducted by a single arbitrator appointed in accordance with such rules. The decision of the arbitrator shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights pending the completion of arbitration.

You may terminate your use of our Services at any time by ceasing to use our Services and, if applicable, deleting your User Account.

We may terminate or suspend your access to all or part of our Services, with or without notice, at any time and for any reason, including, without limitation, if we believe that you have violated or acted inconsistently with the letter or spirit of these Terms.

Upon termination, your right to use our Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and APK Pure Games regarding our Services and supersede any prior agreements between you and APK Pure Games relating to your use of our Services.

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

You may not assign these Terms or any rights or obligations hereunder, by operation of law or otherwise, without our prior written consent. We may assign these Terms without your consent to any affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and you do not have any authority of any kind to bind us in any respect whatsoever.

Any notices or other communications provided by us under these Terms will be given by posting to our Services or via email. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.

We will not be liable for any failure or delay in our performance under these Terms due to any cause beyond our reasonable control, including acts of war, acts of God, earthquake, flood, embargo, riot, sabotage, labor shortage or dispute, governmental act, or failure of the Internet.

The section titles in these Terms are for convenience only and have no legal or contractual effect.

These Terms do not confer any third-party beneficiary rights.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our Services.
